Terms and Conditions

1. Scope
These Terms and Conditions govern the contractual relationship between PicheleMarkt and its customers for the sale of products via the website pichelemarkt.com. By placing an order, the customer unreservedly accepts these Terms.
2. Products
PicheleMarkt offers products from international suppliers. The essential characteristics of the products (descriptions, prices, availability) are presented on the respective product pages. Images are for illustration only. Minor variations in colour or appearance are possible.
3. Prices
All prices are final prices in Euro (€). As a small business under § 19 of the German VAT Act (UStG), no VAT is charged or shown; prices therefore do not include VAT. Shipping is included in the price on all orders and no further costs are added. The price valid at the time of the order applies.
4. Order and Conclusion of Contract
The customer places their order via pichelemarkt.com. The contract is concluded upon confirmation of payment. PicheleMarkt confirms the order by email and reserves the right to cancel orders in the event of supply shortages or obviously incorrect prices. The contract language is the language version of the website you selected. We store the contract text and send you the order data by email; it is also available in your customer account. The order is placed in the following steps: add the item to the cart, go to checkout, enter your delivery address, choose a payment method and submit the order using the order button. You can correct your entries at any time before submitting the order.
5. Payment
Payment is made online by credit card (Stripe) or PayPal. The transaction is secure; payment data is never stored by PicheleMarkt. The amount is charged upon completion of the order.
6. Delivery
Products are shipped from our suppliers' warehouses – predominantly from warehouse locations outside the European Union. Estimated delivery times are shown on each product page and at checkout before the order is completed (generally 1 to 7 working days). For deliveries within the European Union, any import charges and import VAT are included in the price. PicheleMarkt is not liable for delays caused by the carrier or customs.
7. Right of Withdrawal
Consumers have a 14-day right of withdrawal. You may withdraw from the contract within 14 days of receiving the goods without giving reasons. The complete withdrawal instructions – including the period and how to withdraw, the legal consequences, the return costs and the model withdrawal form – are available at pichelemarkt.com/de/widerruf. They form part of these Terms and are made available to you before you place your order.
8. Warranty
The statutory warranty rights under §§ 434 ff. of the German Civil Code (BGB) apply. In the event of defects, the customer is entitled to subsequent performance, price reduction, withdrawal or damages under statutory provisions. The warranty period is 2 years from receipt of the goods.
9. Liability
PicheleMarkt is liable without limitation for intent and gross negligence and under the Product Liability Act. For slightly negligent breach of essential contractual obligations, liability is limited to foreseeable, contract-typical damage. Otherwise liability is excluded.
10. Personal Data
The personal data collected is processed in accordance with our Privacy Policy and the GDPR. The customer has the right to access, rectify and delete their data.
11. Dispute Resolution
German law applies. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Please address complaints to contact@pichelemarkt.com.
